Condominiums in Puerto Escondido: the regime and fees nobody explains to you

Before buying a condo: what the condominium regime is, what the maintenance fee covers, whether short‑term rentals are allowed, and the questions that prevent surprises.

Almost all new apartments in Puerto Escondido are sold under a condominium regime. And almost no buyer asks about that regime until the contract is already signed. It’s an expensive mistake, because the document that governs your condominium defines how much you pay each month, what you can do with your unit and —the big one— whether you can rent it by night.

What buying a condo means

When you buy a condominium unit you acquire two things: the exclusive ownership of your apartment and an undivided share of the common areas (pool, hallways, rooftop, parking, roof, cistern). That second part generates obligations: you pay its maintenance and you participate in decisions about it through the owners' assembly.

All of this lives in two documents you should read before signing: the constitutive deed of the condominium regime and the internal regulations. They are not entertaining reading, but they are the ones that rule.

The maintenance fee: the number that doesn’t appear in the ad

It is a monthly, recurring and mandatory expense. It varies enormously depending on the development: a ten‑unit building without amenities charges little; a condominium with pool, gym, rooftop, 24‑hour security and green areas charges much more, because all that is paid by the owners.

What you must always request, in writing:

  • The exact amount of the current fee and what concepts it covers.

  • If there are extraordinary fees planned or recent (for example, to repair waterproofing or replace the pump).

  • The status of the reserve fund. A condominium without a reserve is a condominium where any major repair becomes a surprise extraordinary fee.

  • If there are delinquent owners. If several don’t pay, those who do end up covering the gap.

The critical point: does it allow short‑term rentals?

If your plan is to rent by night, this is the most important question of all, and the one that causes the most headaches when asked too late. Some regulations forbid vacation rentals, others limit them to a certain number of days or require guest registration, and others allow them without issue because the whole development is designed for that.

Never assume it is allowed because the seller says so verbally. Ask for it in the written regulations. We have seen buyers build their entire rental projection on a unit where the assembly later voted to prohibit it.

Five other questions we always ask

  • Is the condominium regime constituted? In new construction, it is sometimes sold before being formally constituted. Without a registered regime there is no individual deed for your unit.

  • What is your undivided share? It determines how much you pay in fees and how much weight your vote has in the assembly.

  • How is it managed? Professional administrator or a volunteer neighbor? The difference shows up in maintenance after three years.

  • What about water? On the coast it is the most delicate service. Ask if there is a cistern, its capacity, and whether the supply comes from the grid or by truck.

  • Are there restrictions on remodeling or pets? They sound like details until they affect you.

None of this is a reason to discard the condo

On the contrary: for an investor who lives in another city, the condominium is the most comfortable format that exists. Someone maintains the common areas, there is security, and the operation does not depend on you being present. You just have to enter with open eyes and the documents read.
